HISA Said To Be Delaying Launch Of Anti-Doping And Medication Control Program Until May 22

Already delayed one month by a court order, the Horseracing Integrity and Safety Authority’s Anti-Doping and Medication Control program will not launch until May 22, according to information provided on Tuesday to the Pennsylvania State Horse Racing Commission by Tom Chuckas, the regulatory agency’s Thoroughbred bureau director.

Chuckas told commissioners during a regularly scheduled meeting that the program is being delayed from May 1 in part because of the Triple Crown, which gets under way on May 6 with the Kentucky Derby and continues with the Preakness Stakes on May 20. The third leg of the Triple Crown, the Belmont Stakes, is run on June 10.

Chuckas said he was notified of the delay by an individual associated with the Horseracing Integrity and Welfare Unit, a newly formed division of Drug Free Sport International contracted by HISA to administer its regulations and enforcement rules. The comment was made as part of Chuckas’ update to the Pennsylvania commission on HISA and HIWU activities.

Delta Downs Named Best Horse Racing Track by USA TODAY 10Best Readers’ Choice Awards

Losing Side in Sixth Circuit HISA Appeal Wants Rehearing

Six weeks after the United States Court of Appeals for the Sixth Circuit upheld the constitutionality of the Horse Racing Integrity and Safety Act (HISA), the losing plaintiffs/appellants in a case led by the states of Oklahoma, West Virginia and Louisiana have petitioned for a rarely granted “en banc” procedure that asks for a rehearing before all 28 of that court’s judges instead of just the panel of three that issued the Mar. 3 decision.

“A panel of this Court [held] that the [HISA] Authority’s ability to issue federal regulations over the Federal Trade Commission [FTC]’s objection does not violate the private non-delegation doctrine because, since the [December 2022] statutory amendment, the FTC can modify those rules after the fact,” the Apr. 17 filing stated.

“The panel also refused to decide whether the Authority’s exclusive power to bring enforcement actions in federal court was unconstitutional, and it concluded that HISA’s fee-collection regime does not unconstitutionally coerce the States to administer a federal regulatory program,” the filing stated.

Desormeaux Full of Confidence About His Derby Angle

We got the gist. Apparently, though, no one’s been heeding the advice of the former chief executive, at least when it comes to the young horses of trainer Keith Desormeaux stepping up in the springtime for any number of Triple Crown preps. For instance:

In January of 2022, Desormeaux came out firing with the Midnight Lute colt Call Me Midnight to win the Lecomte Stakes (G3) at Fair Grounds, knocking off 3-year-olds trained by Steve Asmussen, Brad Cox, and Mark Casse. He paid $59 for a $2 bet.

GRAYSON-JOCKEY CLUB RESEARCH FOUNDATION APPROVES FUNDING FOR NEW EHV-1 AND EHM VACCINE RESEARCH

Considering the series of major outbreaks of equine herpesvirus (EHV-1) and its sequel EHM in North America and Europe over the past decade, the Grayson-Jockey Club Research Foundation issued a special call for research proposals to address the issue.

EHV-1 and EHM are highly contagious, affecting horses of every breed and discipline, and they continue to cause significant economic losses through closures of racetracks and sales barns, delays in training schedules, and severe disease and death of horses.

After a thorough review process by the foundation’s veterinarian advisory committee, two research proposals were selected for funding. The projects, led by Gisela Soboll Hussey of Michigan State University and Bettina Wagner of Cornell University, aim to develop novel nucleic acid vaccines to protect horses from EHV-1/EHM and EHV-4.

Soboll Hussey’s project is titled, “Use of nucleic acid vaccines to protect from EHV-1/EHM,” and it will last three years. Her objective is to develop a novel mRNA-based EHV vaccine that protects horses from EHV-1 myeloencephalopathy, a method that will likely cross-protect horses against other types of equine herpesviruses.

Wagner’s project, titled, “A novel DNA vaccine platform to control EHV-1 and EHV-4,” will span two years and aims to develop an effective DNA vaccine for EHV-1 to protect horses against infection and disease, working to prevent catastrophic EHV outbreaks in the future.

Total funding for the projects of $1,885,436 was provided by special donor Dr. John Ballantyne and Fargo-Moorhead Area Foundation. “I am excited to support these important research efforts to combat the devastating impact of EHV-1 on equine health,” Dr. Ballantyne said.

Dell Hancock, chairman of the Grayson-Jockey Club Research Foundation, added, “The work of our research advisory committee is timely and essential. We look forward to working with these institutions to develop these vaccines and protect the equine industry from the devastating effects of EHV-1 and EHM.”
